2. Definitions

  • “Employer” refers to users who post jobs.
  • “Fitter” refers to freelancers who apply for and complete jobs.
  • “User” refers to both Employers and Fitters.
  • “Service” refers to the job posting, application, payment processing, and other related services provided by Universal Fitters.
  • “App” refers to the Universal Fitters mobile application available on Google Play and Apple App Store.

3. User Accounts

  • Users must register an account to access certain features.
  • Users must provide accurate and up-to-date information.
  • Users are responsible for maintaining the confidentiality of their accounts.
  • Users have the right to delete their accounts at any time through the app or by contacting support@universalfitters.com.

4. Job Posting & Applications

  • Employers may post job listings with detailed descriptions.
  • Fitters may apply for jobs and must ensure they have the necessary skills to complete the work.
  • Universal Fitters is not responsible for verifying job details, employer credibility, or fitter qualifications.
  • Employers and Fitters must comply with all relevant laws and regulations.

5. Payments & Fees

  • Employers may be required to make payments for job postings and hiring services.
  • Fitters will receive payments upon job completion and approval by the Employer.
  • Universal Fitters may charge service fees, which will be included in prices displayed.
  • Payments will be processed through our third-party payment providers, including Stripe, PayPal, and other secure methods.

6. Dispute Resolution

  • Any disputes between Employers and Fitters should first be resolved through mutual communication.
  • If unresolved, Universal Fitters may mediate but is not legally obligated to intervene.
  • Refunds and chargebacks are subject to investigation and approval.

7. User Conduct

  • Users must not post false, misleading, or illegal job listings.
  • Fitters must complete jobs professionally and as agreed upon.
  • Users must not engage in fraudulent activities, harassment, or abuse.
  • Employers and Fitters must adhere to Google Play and Apple App Store content guidelines.

8. Liability & Indemnification

  • Universal Fitters is not liable for job quality, disputes, or damages arising from user interactions.
  • Users agree to indemnify and hold Universal Fitters harmless from any claims, losses, or damages.

9. Termination of Account

  • We reserve the right to suspend or terminate user accounts for violations of these terms.
  • Users may request account deletion directly within the app or by contacting support@universalfitters.com.

10. Modifications

  • We reserve the right to update these Terms & Conditions at any time. Continued use of our Website and App constitutes acceptance of any updates.

11. Governing Law

  • These Terms & Conditions shall be governed by the laws of the United Kingdom.

7. Platform Ownership of Introductions

Universal Fitters is the sole introducer of Employers
and Fitters.

Any connection, communication, booking, or awareness between
Users that arises in any way from the Platform is deemed a protected
introduction
owned by Universal Fitters.

7.1 Absolute Non-Circumvention

For 12 months from the date of first interaction,
Users shall NOT, directly or indirectly:

  • Work together outside the Universal Fitters platform
  • Attempt to avoid fees, commissions, or bookings
  • Exchange personal contact details for off-platform work
  • Offer or accept private, cash, future, or “side” jobs
  • Use third parties, relatives, staff, or associated businesses to bypass the platform

Any attempt to bypass Universal Fitters for financial gain is strictly prohibited.

7.2 Non-Solicitation

Users shall not:

  • Solicit Introduced Users for direct employment
  • Offer future work outside the platform
  • Encourage off-platform communication or payments
  • Refer Introduced Users to other businesses to avoid Universal Fitters

This restriction applies whether or not a job was
completed
.

7.3 Liquidated Damages

Users agree that ANY breach of this section results in immediate financial liability of:

£5,000 PER USER, PER BREACH

OR

100% of all work completed or reasonably expected over a 12-month period

WHICHEVER IS GREATER

This amount is agreed to be a genuine pre-estimate of loss, including lost revenue, damage to platform integrity, and operational
disruption.

7.4 Evidence & Enforcement

Universal Fitters may rely on:

  • Usage patterns
  • Repeated interactions
  • Timing of bookings
  • Circumstantial or inferred evidence

Direct written proof is NOT required where circumvention is reasonably inferred.

7.5 Injunctive Relief & Legal Costs

Universal Fitters may seek:

  • Immediate court injunctions
  • Orders preventing further contact
  • Full recovery of legal fees, enforcement costs, and damages

7.6 Account Termination & Forfeiture

Any breach may result in:

  • Immediate account termination
  • Permanent platform ban
  • Loss of unpaid balances, credits, or future access

8. User Rights

  • Users may request access, correction, or deletion of personal data by contacting support@universalfitters.com.
  • Users can delete their accounts directly through the app settings.

9. Third-Party Links

  • Our website and app may contain links to third-party websites. We are not responsible for their privacy policies.
